Our Privacy Policy

bodykindyoga.com is the website for Body Kind Yoga. This privacy policy will explain how our organization uses the personal data we collect from you when you use our website.

We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

This document should be read in conjunction with our Yoga Class Terms and Conditions, and Website Terms and Conditions.

‘You/Your/Yours/The User’ in this context refers to you/the individual using The Website.

What data do we collect?

We collect data, including information that you provide via our Contact and Booking Forms. This may include personal identification information (your name and email address).

How do we collect your data?

You directly provide us with most of the data we collect. We collect data and process data when you:

– contact us or order any of our products or services.

– complete a customer survey or provide feedback/comments on any of our message boards or via email.

We may also receive your data indirectly from Google Analytics (see ‘Google Analytics’ section).

How will we use your data?

We collect your data so that we can:

– respond to queries and comments about our Website or our Services.

– process your orders of our goods and/or services and provide services to you.

– (with your consent only) email you with news and offers that we think you might like.

– for the purposes of evaluating your use of our website, compiling reports on website activity, and providing other services related to website activity .

– comply with legal and insurance requirements and obligations.

– protect our interests, including detecting any malicious or fraudulent activity.

Payments

An external payment service provider, ‘Stripe’, processes any payments by credit card, bank transfer or other means through my booking system. While we will collect and store information such as your name and email address for the purposes of processing your orders of goods and services, we will not collect and/or store your payment information (except for the last four digits of your card number, if applicable).

The User is requested to provide their payment details and personal information directly to Stripe, via a form provided by one of Stripe’s partners. We will receive a notification by the relevant payment service as to whether payment has been successfully completed, along with your name, email address, and order details.

Your payment will be processed by Stripe, who collect, use and process your information, including payment information, in accordance with their privacy policies. Stripe’s privacy policy can be found here and its Service Agreement can be found here.

If you do not wish to use this service, you can contact us to arrange an alternative payment method.

How do we store your data?

We take reasonable precautions to securely store your data. This includes:

– Using reputable companies to host our website, handle email traffic, and store your data;

– Using firewall software to monitor and protect our website;

– Password protecting sensitive information;

– Limiting access to information to only those who have a legitimate business need to view it;

– Having procedures in place to handle any data breaches.

Depending on your location, data transfers may involve transferring the User’s Data to a country other than their own. The information that we collect from you will sometimes be sent and stored outside the United Kingdom and/or the European Economic Area (“EEA”). Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Please read this document carefully before booking a class. By booking a class, you are confirming that you have read, understood and agreed to these conditions.

This document should be read in conjunction with our Privacy Policy, and Website Terms and Conditions.

Unless otherwise specified, definitions as defined in our Privacy Policy and Website Terms and Conditions apply.

Waiver

– I understand that I am participating in a Yoga Class, Workshop, or Pre-registered yoga session offered by Body Kind Yoga during which I will receive information / instruction about Yoga, including Asana, Pranayama, Kriya, chanted Mantra and seated meditation. I recognize that yoga may require some physical exertion, which may be strenuous and may cause physical injury. I am fully aware of the risks and/or hazards involved.
– I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Yoga Class, Workshop, or Pre-registered yoga session. I certify that I am physically fit and I have no medical condition, which would prevent my full participation in the Yoga Class, Workshop or Pre-registered yoga session, unless stated to the teacher beforehand.
– I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in any yoga program provided by Body Kind Yoga including online and in-person classes.
– I knowingly, voluntarily and expressly waive any claim that I may have against Body Kind Yoga and its owner and teacher, for any injury, death or damages that I may sustain as a result of participating in a Yoga Class, Workshop or Pre–registered yoga session hosted by Body Kind Yoga online or at an in-person location; including loss that may be caused by the negligence of the released party.
– I release and discharge Body Kind Yoga, its owner and its instructor from any and all liability, claim, demand or action that I may have related to the loss, theft or damage of any of my personal property while participating in any activity hosted by Body Kind Yoga online or in-person.
– I, my heirs or legal representatives, forever release, waive, discharge and covenant negligence or other acts.

Cancellation Policy/No Shows

If you need to cancel your class, do not worry.

For group classes, you can cancel for a full refund, or transfer your booking to any other available scheduled class, up to 12 hours before the class starts by contacting me.

Cancellations made within 12 hours of the start of the class (“Late Cancellations”) will be charged at the full rate for the class. If you do not show up to the class (“No Show”), this will be treated as a Late Cancellation.

In the unlikely event that the class is cancelled you will receive as much notice as possible, and a full refund or the opportunity to transfer to an alternative date.

Cancellation/no show policies for private may vary depending on the client. I will always provide these before we agree on your class/package.

Lateness Policy

Please arrive at least 10 minutes before the scheduled class time for in-person classes or 5 minutes for online classes. If you arrive late, I may not be able to admit you to the class. This is to prevent your injury, and in order to avoid disrupting other students.

Provision of Services

Provision of any products and services advertised on the Website are at the sole discretion of Body Kind Yoga.

Body Kind Yoga reserves the absolute right to accept or refuse access to the Website and/or Services and to accept or refuse payment made in any form.

Body Kind Yoga will keep up to date with any changing information regarding COVID-19 in the future. As all government guidelines surrounding COVID-19 are no longer in place, Body Kind Yoga will no longer follow the strict guidelines.

COVID-19 is still circulating, so please be mindful of others if you are unwell, and take any precautions that are comfortable for you to take.

By attending a class with Body Kind Yoga you acknowledge the risks and place no responsibility on Body Kind Yoga should you contract COVID-19 in the future.
